If a company doesn’t do its homework when hiring a new employee, or if a company retains an employee that has proven to be unfit, or fails to properly train or supervise an employee, it exposes itself to liability.
Negligent hiring occurs when an employer fails to do a proper background check on an employee and/or hires an employee who is not qualified or competent to carry out a particular job.
Negligent supervision is when an employee has not been properly supervised or trained to do their job and this ends up harming a customer or invitee. Negligent supervision can also include a business not properly supervising its property.
Customers and others who are injured as a result of a company’s negligent hiring or retention of an employee, or the negligent supervision of a business or property, may be entitled to recover for their damages.
